hereinafter referred to as "the Parties".

 

Preamble:  The Parties, recognizing that cooperation for the conservation of wild Atlantic salmon is in their mutual interest, seek long-term solutions and enter into the following

 

AGREEMENT

 

Article 1:  KNAPK and the Greenland Home Rule Government jointly agree to suspend all fishing for Atlantic salmon within Greenland territorial waters while this Agreement is in effect, except for an annual subsistence harvest (this means no commercial sale - that is no sale to factories, shops, grossists, smokehouses or marketing associations or export).

 

Article 2:  NASF agrees to pay 1.5 million Danish Kroner (approximately U.S.$200,000) each year that this agreement is in effect into a trust account ("the Trust Fund"), which KNAPK and NASF shall establish jointly to finance projects identified and approved under Article 3. KNAPK shall provide semi-annually to NASF a full financial accounting of the expenditure of funds paid from this account.

 

Article 3:  KNAPK and NASF shall jointly identify projects that will benefit KNAPK and Greenland's inshore fishing industry and will reinforce or compliment development programmes, either national or in individual coastal communities, of the Greenland Minister of Fisheries, consistent with the EU-Denmark/Greenland Fisheries Agreement. Projects should be designed to facilitate development of new fisheries or other economic activities, which can provide employment to Greenland society. Such projects and their associated costs, such as preparation expenses, initiation expenses, study trips, services, and purchase of equipment, which are approved by KNAPK and NASF shall be financed from the Trust Fund.

 

Article 4:  Inasmuch as wild salmon caught off Greenland are of both European and North American origin, the Parties shall seek to obtain matching funds from sources in Europe as well as North America to strengthen the foundation of projects approved under Article 3.   To help KNAPK meet its obligations under this Agreement, NASF agrees to transfer to KNAPK Headquarters funds to cover the cost of administration, travel and a monitoring programme related to the implementation of this Agreement in amounts of DKK 207,000 payable on August 12, 2002, DKK 207,000 on September 30, 2002, and DKK 200,000 on May 1 of each year thereafter while this Agreement is in effect.

 

Article 5:  Recognizing that the suspension of salmon fishing required under Article 1 may cause economic hardship to those fishermen and their families who have been most active in this fishery, NASF agrees to pay DKK 287,000 on August 31, 2002 into a special economic adjustment fund established by KNAPK which shall be used to help the families of these fishermen to purchase gear and equipment or find alternative income. NASF shall pay an additional DKK 500,000 into this fund on May 1 of each year while this Agreement is in effect.

 

Article 6:  This Agreement is endorsed by the Atlantic Salmon Federation (ASF) and the National Fish and Wildlife Foundation (NFWF), ("the Sponsors"), each of whom has a vested interest in the conservation of wild Atlantic salmon and agrees to help implement this Agreement. The Sponsors shall use their best and good faith efforts to seek to obtain funds to help NASF meet its financial obligations under this Agreement.

 

Article 7:  This Agreement shall go into effect on the date of signature by the last of the two listed Sponsors and GHRG to sign; the Parties having signed beforehand. One half of the 2002 payment specified in Article 2 shall be deposited into the Trust Fund within fifteen days thereafter and the second half by September 30, 2002.

 

Article 8:  Initially, this Agreement shall cover the 2002 fishing season and remain in effect through April 25, 2003. Thereafter, its terms and conditions may be extended yearly to cover the successive 2003-2006 fishing seasons. This extension, from April 25, 2003 through April 25, 2007, shall take place automatically unless either Party gives written notice to the other by April 25, yearly of its intent to terminate the Agreement. During the extension payments required under Article 2 shall be deposited into the Trust Fund semi-annually in equal amounts on April 30 and September 30.

 

Article 9:  The Parties shall review the overall operations of this Agreement at least annually and at any time may suggest and mutually agree on ways to improve the implementation of Article 3.

 

Article 10:  This Agreement may be amended with the consent of the Parties and Sponsors.

 

Done at Reykjavik and Nuuk this 9th day of August, 2002, in duplicate, in the Greenland and English languages, both texts being equally authentic.
